Terms of Service

Effective date: May 7, 2026. This document is standard boilerplate for a software service. Have qualified legal counsel review and adapt it for your organization before relying on it.

1. Agreement

These Terms of Service ("Terms") govern your access to and use of AccessScout, a subproduct of Zaviora offered by Bostrix, Inc. ("Bostrix," "we," "us," or "our") through https://accessscout.zaviora.com and related interfaces (collectively, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

If you use the Service on behalf of a company or other entity, you represent that you have authority to bind that entity, and "you" includes that entity.

2. The Service

The Service provides automated accessibility scanning, reporting, and related features. Output is informational and may be incomplete, inaccurate, or unsuitable for your specific legal, operational, or compliance needs. The Service does not constitute legal, professional, or compliance advice. You are solely responsible for your websites, applications, content, and compliance obligations.

3. Accounts and eligibility

You may need to register an account. You agree to provide accurate information and keep it current. You are responsible for safeguarding credentials and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or present security or abuse risk.

You must be at least the age of majority in your jurisdiction (or older if required by applicable law) to use the Service. The Service is not directed to children under 13 (or the minimum age required in your region).

4. Acceptable use

You agree not to:

  • Violate any law or third-party rights.
  • Probe, scan, or test the vulnerability of the Service or any system without authorization, or bypass security measures.
  • Use the Service to access or interfere with networks, systems, or data you do not own or lack permission to test—including attempting SSRF, credential stuffing, or distributed attacks.
  • Reverse engineer, decompile, or attempt to extract source code except where prohibited restrictions are unenforceable under applicable law.
  • Overload or disrupt the Service, or use it to send malware or unlawful content.
  • Misrepresent your identity, affiliation, or the origin of data you submit.
  • Use outputs of the Service to harass, defame, or harm others, or in ways that violate accessibility or anti-discrimination laws as applied to your conduct.

5. Customer content and scans

You retain ownership of content you submit (for example, URLs you request us to scan). You grant us a non-exclusive license to host, process, transmit, and display such content solely as needed to operate, secure, improve, and support the Service. You represent that you have all rights necessary to submit URLs and to authorize automated retrieval and analysis consistent with these Terms.

We may collect technical metadata (such as timestamps, rule identifiers, and structured scan results). Depending on configuration and incident response, limited snapshots or logs may be retained for security or reliability; see our Privacy Policy for details.

6. Fees and payment

Paid plans, trials, taxes, invoicing, and refunds are governed by the checkout flow and policies presented at purchase (including third-party processors such as Stripe). Failure to pay may result in suspension of paid features. Price changes will be communicated as required by applicable law.

7. Third-party services

The Service may integrate with or link to third-party services (including hosting, analytics, authentication, email, and payment providers). Those services have their own terms and privacy policies. We are not responsible for third-party services or content at URLs you submit for scanning.

8. Intellectual property

Excluding your content, the Service, software, documentation, trademarks, and branding are owned by Bostrix or its licensors and are protected by intellectual property laws. Except for the limited right to use the Service in accordance with these Terms, no rights are granted to you.

9. Confidentiality

If we disclose non-public information to you marked as confidential (or which reasonably should be treated as confidential under the circumstances), you will protect it with reasonable care and use it only for the purpose provided.

10. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOSTRIX AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND LICENSORS DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, AND NON-INFRINGEMENT.

Without limiting the foregoing, we do not warrant that:

  • The Service will be uninterrupted, error-free, secure, or free of harmful components.
  • Scan results will be complete, current, or suitable for regulatory, legal, or certification purposes.
  • Use of the Service will ensure compliance with the Americans with Disabilities Act (ADA), Section 508, WCAG, EN 301 549, or any other statute, regulation, or standard.

Automated tools cannot evaluate every accessibility barrier (for example, many cognitive, situational, and qualitative issues require human judgment). You assume all risk from decisions you make based on the Service.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL BOSTRIX OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOSTRIX'S AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO BOSTRIX FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100), IF YOU HAD NO FEES DURING THAT PERIOD.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

12. Indemnification

You will defend, indemnify, and hold harmless Bostrix and its affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your content or URLs submitted to the Service; (b) your violation of these Terms or applicable law; (c) your violation of third-party rights; or (d) disputes between you and your users or customers. We may assume exclusive defense and control of any matter subject to indemnification, at your expense, and you will cooperate with our reasonable requests.

13. Suspension and termination

We may suspend or terminate access to the Service at any time, with or without notice, for conduct that we believe violates these Terms, creates risk, or is otherwise harmful. You may stop using the Service at any time. Provisions intended to survive (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive termination.

14. Changes

We may modify these Terms by posting updated Terms and updating the effective date. If changes are material, we will provide notice as required by law. Continued use after the effective date constitutes acceptance of the revised Terms. If you do not agree, stop using the Service.

15. Export and sanctions

You represent that you are not located in, under the control of, or a national or resident of any country or entity subject to comprehensive U.S. sanctions or similar restrictions, and that you will comply with export control laws applicable to your use of the Service.

16. Governing law; disputes

These Terms are governed by the laws of the United States and the State in which Bostrix, Inc. maintains its principal place of business, without regard to conflict-of-law principles. The exclusive venue for disputes arising out of these Terms or the Service will be the state and federal courts located in that State, unless applicable law requires otherwise; you consent to personal jurisdiction there.

17. General

These Terms, together with any order form or checkout terms you accept, constitute the entire agreement between you and Bostrix regarding the Service and supersede prior understandings on the subject. If any provision is unenforceable, the remainder remains in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Notices may be provided by email or via the Service.
